Staff Analysis of the Legislation

This legislation allows motorcyclists and bicyclists to treat any signal as a stop sign if the motorcyclist determines that the traffic signal is inoperative because of the light weight of the motorcycle. The driver bears the burden of proving whether he/she acted with reasonable belief. Such driver's cause or proximate cause of an accident under these circumstances shall be prima-facie evidence that the driver did not exercise due care or the requisite consideration required in conformance with this law.
